For the purpose of assisting law enforcement authorities and agencies in carrying out their legal duties and conducting investigations, this Law Enforcement Guide (the “Guide”) is made available for perusal. YumyHub cooperates with law enforcement efforts globally. Nothing on this page is intended as legal advice. Before submitting a law enforcement request to YumyHub, please read this guide.

General Questions

Our Contact Form can be used to send general questions from law enforcement, military, or government officials without making a request to delete, preserve, or disclose account information or material. Please follow the procedures below to submit all other official requests using our Law Enforcement Request Form.

Requests for Content Removal

Depending on the circumstances, and solely and completely in our discretion, we may comply with a request from law authorities to take down content that is illegal or otherwise infringes on our Terms of Service. A genuine official return email address, the name and title of the seeking official, a URL to the content that is being requested be removed, and the legal justification for the removal must be included in every law enforcement request to have content removed. Our content removal and legal teams will receive such requests and review and respond as necessary.

Account Information Available

Our Privacy Policy details our practices for collecting, safeguarding, and keeping data. Several variables, including as the type of account and the user’s behaviors, affect the type and extent of information gathered, how it is collected, and how long it is retained.
As an illustration, Fans are not needed to supply the same degree of account registration information as Creators, whereas Creators are subject to strict age and identity verification procedures. There might be some users who can broadcast live. Live broadcasts are not kept on file or are kept just shortly.
Law enforcement can easily browse and/or subscribe to a user’s profile to obtain some stored profile content. The username, display name, profile photo, bio, URL, subscription offers, tip requests, and posts—which may contain text, photographs, videos, and/or comments—are some examples of the information that may be included.
If law enforcement receives formal legal process, they might also get access to other non-public account information. This legal procedure may take the form of a subpoena, production order, judicial authorisation, search warrant, or court order, depending on the originating jurisdiction and the records being requested. The user’s registration details (such as the email address linked to the account), identification papers, tax returns, linked social media accounts, billing and revenue information, subscribers, private messages, and captured user activity, which may include IP address logs and other data, are examples of non-public account information that may be available.
Users control all of the private messages and profile content that is saved, so if the user deletes any of it before we have had a chance to fulfill a legitimate law enforcement request, that information may no longer be available. While an account is suspended, some profile content cannot be saved in real time. YumyHub retains all control over account suspension.
You should be aware that YumyHub is based in and run out of the US. As a result, the US is where all user data is stored. No locations or addresses outside of the United States are kept by us.

Preservation Requests

YumyHub will comply with law enforcement’s requests for temporary, informal preservation when it is permissible and the documents are important pieces of evidence in an ongoing case or inquiry. All preservation requests must be submitted via our Law Enforcement Request Form and include a valid official return email address, the name and title of the requesting official, the duration of the preservation, a description of the information to be preserved and how it relates to your investigation, and at least one of the user identifiers below:

  2. Profile URL
  3. Email address
  4. Legal name
  5. Telephone Number
  6. Billing address
  7. Credit card information (must include first six and last four numbers of the credit card, dates and times of suspected transactions, and the legal name of the account holder)
We are unable to respond to requests for preservation that are too general, ambiguous, or tardy. Any preservation request that lasts longer than ninety (90) days may be subject to formal legal procedure. On a law enforcement agency’s request and under the right conditions, we might agree to extend the preservation time. A separate request should be made for each request to extend the preservation period.

Information Requests for Non-Public Accounts

Law enforcement won’t be able to access non-public account information unless they have a valid emergency request, which is covered in more detail below, or they have the proper legal authority, such as a subpoena, production order, judicial authorization, search warrant, court order, or other legal process. The categories of sought user data and the relevant law will determine the type of legal process that is necessary. While law enforcement requests may be sent to Yumy Brands, LLC. 1001 S Main St #49 Kalispell, MT 59901, all requests for account information and inquiries about legal process should be submitted through our Law Enforcement Request Form using a valid official return email address, the name and position of the requesting official, the response deadline, a description of the information to be disclosed and its connection to your investigation, and at least one of the following:

  2. Profile URL
  3. Email address
  4. Legal name
  5. Telephone Number
  6. Billing address
  7. Credit card information (must include first six and last four numbers of the credit card, dates and times of suspected transactions, and the legal name of the account holder)
Requests for confidential account information that are too general or ambiguous cannot be processed. Also, unless there are exceptional circumstances, we have the right to reject requests that are limited to stored profile information that is easily accessible to law enforcement through profile viewing and/or subscription.

Emergency Requests

If we are given a good faith reason to believe that a person is in imminent danger of death or serious physical injury, we may, in certain emergency situations that are determined by us on a case-by-case basis at our sole and absolute discretion, grant a law enforcement request for non-public account information without formal legal process. Any information required to stop that harm may be the only information provided in responses. All emergency requests must be made through our Law Enforcement Request Form and include a valid official return email address, the name and position of the requesting official, the response deadline, the nature of the emergency (such as an assault, kidnapping, or other form of trafficking), the identity of the person who is in danger of death or serious bodily harm, a description of the harm that must be avoided, the information that must be disclosed, and a description of how that information is to be disclosed.

We cannot process overly vague, broad, or routine inquiries as emergency requests.

Cost Reimbursement

To the extent that it is allowed by law, YumyHub may seek compensation for the expenses related to any requests for information preservation.

Responses

Despite our best efforts, response timeframes may differ depending on the specifics of the request and the volume of other requests at the time. We aim to fulfill all routine requests within fourteen (14) days of receipt. Please refrain from sending several follow-up inquiries because doing so can extend the time it takes to respond to all of them.
Except as otherwise agreed by us, we only give responsive records in electronic form that may be viewed using standard office software.

Certificates and Affidavits of Records

Depending on your particular jurisdiction, a suitable records custodian affidavit or a certification of foreign business records will be provided. If such a certification or affidavit is required, kindly submit the request with your legal paperwork.

Disclosure of Requests

Users are not informed of any inquiries made by law enforcement by YumyHub.

Mutual Legal Assistance Treaties

Upon proper serving of process, we will immediately reply to requests made under a mutual legal aid treaty (“MLAT”) or by letters rogatory. Please clearly state that a request is coming through an MLAT procedure and indicate the name of the country that the request is coming from. Typically, processing a request from law enforcement doesn’t necessitate an MLAT.

English Language

The language of all requests from law enforcement should be English, or an official English translation should be provided. We reserve the right to delay or reject any requests made in a language or with characters that are not English.

No Waiver

Transmission and reception of communication as previously indicated is simply for convenience and does not waive any objections, including those to lack of personal jurisdiction or improper serving of process. Longer response times should be expected from law enforcement agencies who do not file legal demands using our Law Enforcement Request Form.
